CIS Releases May 2017 AOS Filing Dates

As stated in the MIGblog post of April 19, 2017 (link here), the Immigration and Nationality Act ("INA") sets annual worldwide and per-country numerical limits on employment-based and family-sponsored immigrant visas. These visas are supply-side "products," allocated on a first-come, first-served basis (in sequential order, based upon applicants' priority dates). The May 2017 Visa Bulletin is issued on the basis of reported demand received from the DOS (visa applicants) and the CIS (adjustment applicants) by April 11, 2017.

If the CIS determines that there are more immigrant visas available for a fiscal year than there are known applicants for such visas, it will make a published determination (link here) that applicants may use the "Dates for Filing Visa Applications" chart. Otherwise, it will determine that applicants must use the "Application Final Action Dates" chart to determine when they may file their adjustment of status applications. The CIS anticipates designating one of the two charts each month and linking to the relevant chart within one week of the DOS's publication of the Visa Bulletin.

For May 2017:

For both Family-Sponsored Filings and Employment-Based Preference Filings, applicants must use the "Final Action Dates" chart in the DOS Visa Bulletin for May 2017.
