Secretaries of Homeland Security and Labor to Increase H-2B Cap for Remainder of FY2017 by an Additi
Pursuant to a temporary rule to be published tomorrow in the Federal Register, the Secretaries of Homeland Security and Labor will be increasing the H-2B cap for the remainder of FY2017 by an additional 15,000 visas. The rule will be effective from the date of publication in the Federal Register through September 30, 2017, with the exception of document retention provisions, which are effective through September 30, 2020.
From the advance copy obtained by AILA: "The Secretary of Homeland Security ('Secretary') , in consultation with the Secretary of Labor, has decided to increase the numerical limitation on H-2B nonimmigrant visas to authorize the issuance of up to an additional 15,000 through the end of Fiscal Year (FY) 2017. This is a one-time increase based on a time-limited statutory authority and does not affect the H-2B program in future fiscal years. The Departments are promulgating regulations to implement this determination."
